As a conservative I think Olbermann is a loon. The libertarian in me, the libertarian in me that voted Ron Paul, agrees with every word he says though.

An American citizen to be made subject to the MCA would have to actually appear on the battlefield to provide proof in order for the military to detain. The Bush admin. in 2004 made it clear that it would not oppose any habeas petition from an American citizen. Americans were not going to be detained at GITMO. These 270 are aliens captured on foreign battlefields and adjudicated as POWs by 2004 at the latest.They had 3 years to appeal through the DTA and sat on their rights.

My liberties were always well protected by President Bush and the Congress from 9/11 through 2006. And my security as well. No terrorist attacks since 9/11. Congress provided the greatest amount of due process and habeas rights that have ever been provided to alien enemy combatants that were never detained on US soil. The detainees could challenge a judgment of enemy combatant against them in the DC court of appeal and seek remand or release on appeal if the evidence against them is insufficient.There are periodic reviews from the DoD where they can introduce new evidence and seek a subsequent CSRT review of their enemy combatant status.

You are so ignorant.The Congress and the President did devise an effective detainee system in time of war that provided far more habeas rights than ever provided for lawful enemy combatants let alone unlawful combatants, terrorists.Unlawful combatants, under the laws of war, can be shot on site when captured on the battlefield.
